1. Scope
These General Terms and Conditions (GTC) of Natalie Hidalgo - Beach Bun, Alt-ferrachstrasse 31a,
CH-8630 Rüti ZH regulate the rights and obligations in connection with the use of the website www.thebeachbun.com and the online store on this page. Between Natalie Hidalgo and her customers the following General Terms and Conditions (GTC) apply in the version currently available and valid at the time of conclusion of the contract.
Natalie Hidalgo offers swimwear for sale, especially swim dresses and bikinis.
Customer is any person who has business relations with Natalie Hidalgo. These GTC, the terms of delivery and payment as well as the privacy policy of Natalie Hidalgo may be amended from time to time.
These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions require the express written confirmation by Natalie Hidalgo to be valid. The customer confirms with the use of www.thebeachbun.com and/or with an article order or with conclusion of a contract to recognize these AGB, including the terms of delivery and payment, comprehensively.
2. Information on www.thebeachbun.com
www.thebeachbun.com contains information about articles. Prices and assortment remain subject to change. All information on www.thebeachbun.com (item descriptions, images, movies, measurements and other information) are non-binding and do not represent any assurance of properties or guarantees,unless it is explicitly stated otherwise.
Natalie Hidalgo makes every effort to ensure that all details and information on www.thebeachbun.com are correct, complete, up to date and clearly arranged, but Natalie Hidalgo can neither explicitly nor implicitly guarantee this. Natalie Hidalgo cannot guarantee that the items listed will be available at the time of order. Therefore, all information on availability and delivery times are without guarantee and may change at any time and without notice.
3. Prices
The prices on www.thebeachbun.com are gross in the respective currency indicated. Natalie Hidalgo is not liable for VAT. Any shipping and customs costs will be charged additionally, unless otherwise provided for, and are to be paid by the customer.
Shipping costs are shown separately in the ordering process.
Technical changes, errors and misprints are reserved, in particular Natalie Hidalgo can make price changes at any time and without notice.
4. Contract conclusion
The offers on www.thebeachbun.com represent an invitation to order items. By placing an order via www.thebeachbun.com, including the acceptance of these GTC, the customer makes a legally binding acceptance to conclude a contract. Natalie Hidalgo will then send an automatic order confirmation by e-mail.
Orders will be delivered if the ordered item is available. If it turns out after the conclusion of the contract that the ordered article cannot be delivered or cannot be delivered completely, Natalie Hidalgo is entitled to withdraw from the entire contract or from a part of the contract.
The payment already made by the customer will be refunded accordingly. If no payment has yet been made, the client will be released from the obligation to pay. Natalie Hidalgo is not obligated to any replacement delivery and also not obligated to any possible compensation in case of a contract cancellation.
5. Right of withdrawal
The customer is granted a right of withdrawal for 14 days after receipt of the item. The deadline shall be deemed to have been met if the Customer returns the item in question to Natalie Hidalgo within 14 days of receipt, together with the cancellation form. The revocation does not require any justification.
The exercise of the right of withdrawal leads to a reversal of the contract.
The customer must return the item in question unused and together with the cancellation form. Returns to Natalie Hidalgo are at the expense and risk of the customer. Any payment already made (including shipping costs) will be refunded to the Customer within 14 days, provided that Natalie Hidalgo has already received the item in question back or the Customer provides proof that she has returned the item.
Natalie Hidalgo reserves the right to demand reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid or to invoice the customer.
Samples and reduced articles are excluded from the right of withdrawal.
6. Payment options
The customer has the payment options indicated in the order process. Natalie Hidalgo may require payment in advance.
Natalie Hidalgo reserves the right to exclude customers from individual payment options without giving reasons. If the requested advance payment is not received within the time limit, Natalie Hidalgo is entitled to withdraw from the contract and to claim damages.
In the event of payment on account, the customer shall automatically be in default upon expiry of the payment period and shall owe interest on arrears of 5 % per annum.
7. Delivery, duty to inspect and notice of defects
The items are sent by mail to the address specified by the customer in the order. The delivery time is usually three to five working days. Pick-up at Natalie Hidalgo is also possible by appointment.
With the shipment, benefit and risk are transferred to the customer.
Natalie Hidalgo is not liable for any damage caused by a delayed arrival of the article at the customer or third parties.
If the delivery is not deliverable or if the customer refuses to accept the delivery, Natalie Hidalgo may dissolve the contract after a notice of complaint to the customer and setting a reasonable deadline, as well as charge the costs for the inconvenience.
The customer is obliged to inspect the delivered items immediately upon receipt of the delivery and to notify Natalie Hidalgo immediately in writing by e-mail of any defects for which Natalie Hidalgo is liable.
If the inspection by Natalie Hidalgo shows that the articles do not have any detectable defects or that they are not covered by the manufacturer's warranty, Natalie Hidalgo may charge the Customer for the expenses, the return shipment or the possible disposal.
8. Warranty for the purchase of articles
Natalie Hidalgo delivers articles in perfect quality. In the event of defects notified in due time, Natalie Hidalgo warrants that the article purchased by the customer is free of defects and functional during the statutory warranty period of two years from the date of delivery. It is at the discretion of Natalie Hidalgo to provide the warranty by free repair, equivalent replacement or by refund of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear as well as the consequences of improper handling or damage by the client or third parties (especially in case of disregard of Natalie Hidalgo's washing instructions) as well as defects caused by external circumstances.
Textiles may slowly wash out after a few washes, but this is not a defect of the article.
Fading, fabric and material changes due to sunlight or contact with (chlorine or salt) water are also not defects. Any warranty is excluded for sample articles (samples).
9. Liability
Natalie Hidalgo excludes any liability, irrespective of its legal basis, as well as claims for damages against Natalie Hidalgo and any auxiliary persons and vicarious agents. Natalie Hidalgo shall in particular not be liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage and pure financial loss of the client and third parties. Any further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.
Natalie Hidalgo uses hyperlinks on www.thebeachbun.com only for the simplified access of the customer to other web offers. Natalie Hidalgo can neither know the content of these web offers in detail nor assume liability or other responsibility for the content of these websites.
Natalie Hidalgo is not able to give any assurances or guarantees for the topicality, completeness and correctness of the data as well as for the constant or undisturbed availability of www.thebeachbun.com, its functionalities, integrated hyperlinks and further contents. In particular, no representation or warranty is made that the use of www.thebeachbun.com will not infringe rights of third parties not owned by Natalie Hidalgo.

The protection of the personal data of the customers is important to Natalie Hidalgo. Natalie Hidalgo takes the issue of data protection seriously and pay attention to appropriate security. Natalie Hidalgo processes and maintains personal data in accordance with the provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (FADP), the Telecommunications Act (TCA) and, where applicable, other provisions of data protection law, in particular the General Data Protection Regulation of the European Union (GDPR).
The customer agrees that Natalie Hidalgo may use his/her data to carry out advertising measures (online or print), in particular to send him/her information about offers. The customer has the possibility to object to these advertising purposes at any time by notifying Natalie Hidalgo.

11. Other provisions
Should individual provisions of these GTC be void and/or ineffective in whole or in part, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come as close as possible in economic terms to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective manner. The same shall apply in the event of any loopholes in the provision.
In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded. The German version of these GTC is legally binding.
